1. General Terms
1.1 By using this website and making a purchase, you agree to these Terms and Conditions, our Privacy Policy, and other policies governing the use of our website.
1.2 Coastal Art Australia reserves the right to update or modify these Terms and Conditions at any time, and such changes will be effective immediately upon posting.
2. Eligibility
2.1 By using this website, you confirm that you are at least 18 years old or have the permission of a parent or guardian to make a purchase.
2.2 You also confirm that you are capable of entering into a legally binding contract.
3. Product Information
3.1 We strive to ensure all product descriptions, prices, and images are accurate. However, we do not guarantee that the information is error-free or complete.
3.2 Availability of products may vary, and we reserve the right to limit the quantity of items available for purchase.
4. Pricing & Payment
4.1 Prices are in AUD and are not inclusive of GST, as Coastal Art Australia is currently a GST-exempt entity. Prices are subject to change without notice.
4.2 The final price of your order will be confirmed at checkout.
4.3 Payment is due upon checkout, and we accept payments via secure methods, including credit cards, Stripe and bank transfer.
4.4 Coastal Art Australia does not store your credit card details.
5. Shipping & Delivery
5.1 We offer shipping within Australia and internationally. Shipping charges vary, based on the destination.
5.2 Estimated delivery times are provided, but we do not guarantee exact delivery dates. Delays may occur due to factors beyond our control.
5.3 Once your order has been shipped, it is your responsibility to ensure the delivery address is correct. We are not liable for items lost or delayed due to incorrect information.
6. Returns, Refunds and Exchanges
6.1 We accept returns or exchanges for faulty or damaged products.
6.2 In the unlikely event of damage during transit, please provide photos of both the artwork and the packaging within 48 hours of delivery to initiate a claim.
6.3 Returns or exchanges due to change of mind are not accepted, except in certain circumstances outlined in our Returns Policy.
6.4 Refunds will only be issued if the item is deemed faulty or damaged.
7. Commissions
7.1 Commissioned works require a non-refundable 50% deposit to begin. Once the final brushstroke is approved by the client and the balance is paid, no refunds or exchanges are permitted due to the custom nature of the work.
8. Privacy & Data Collection
8.1 Your privacy is important to us. Please refer to our Privacy Policy for details on how we collect, use, and protect your personal information.
9. Intellectual Property
9.1 All content on this website, including images, text, photos, and designs, is protected by copyright law and is owned by Coastal Art Australia.
9.2 Unauthorized use, reproduction, or distribution of any content from this website is prohibited and may result in legal action.
9.3 Ownership of the physical artwork passes to the buyer upon payment, but copyright remains with the Artist. You may not reproduce, scan, or sell prints of the artwork without express written permission from the artist and Coastal Art Australia.
10. Our Agreement & Liability.
10.1 Coastal Art Australia will not be liable for any indirect, incidental, or consequential damages arising from the use of our website or products, including but not limited to loss of profits or data.
10.2 In no event shall Coastal Art Australia's liability exceed the amount paid for the products purchased.
11. Indemnification
11.1 By using our website, you agree to indemnify, defend, and hold harmless Coastal Art Australia, its affiliates, officers, and employees from any claims, damages, or liabilities arising from your use of the site or products.
12. Governing Law
12.1 These Terms and Conditions are governed by and construed in accordance with The Australian Consumer Law (ACL)
12.2 Any disputes arising from these terms will be subject to the exclusive jurisdiction of the courts in Australia.
