1.1 By using this website and making a purchase, you agree to these Terms and Conditions, our Privacy Policy, and other policies governing the use of our website.

1.2 Coastal Art Australia reserves the right to update or modify these Terms and Conditions at any time, and such changes will be effective immediately upon posting.

2.1 By using this website, you confirm that you are at least 18 years old or have the permission of a parent or guardian to make a purchase.

2.2 You also confirm that you are capable of entering into a legally binding contract.

3.1 We strive to ensure all product descriptions, prices, and images are accurate. However, we do not guarantee that the information is error-free or complete.

3.2 Availability of products may vary, and we reserve the right to limit the quantity of items available for purchase.

4.1 Prices are in AUD and are not inclusive of GST, as Coastal Art Australia is currently a GST-exempt entity. Prices are subject to change without notice.

4.2 The final price of your order will be confirmed at checkout.

4.3 Payment is due upon checkout, and we accept payments via secure methods, including credit cards, Stripe and bank transfer.

4.4 Coastal Art Australia does not store your credit card details.

5.1 We offer shipping within Australia and internationally. Shipping charges vary, based on the destination.

5.2 Estimated delivery times are provided, but we do not guarantee exact delivery dates. Delays may occur due to factors beyond our control.

5.3 Once your order has been shipped, it is your responsibility to ensure the delivery address is correct. We are not liable for items lost or delayed due to incorrect information.

Our Love Your Art Guarantee At Coastal Art Australia, we want your new artwork to bring genuine joy and a sense of calm to your sanctuary. We understand that choosing art online is an intimate decision, which is why we want you to feel complete confidence in your purchase.

6.1 Change of Mind Returns (7-Day Policy)
If for any reason you aren’t completely in love with your ready-made artwork or prints once they arrive in your space:

• Notification: Please contact us at the studio within 7 days of delivery to initiate a return.

• Condition: Artwork must be returned unused, undamaged, and in its original archival packaging.

• Return Shipping: Return shipping freight costs are the responsibility of the purchaser and are non-refundable. For peace of mind, return shipments must be fully tracked and insured, as we cannot issue refunds for items damaged or lost during return transit.

• Refund Process: Once received and inspected at our studio, your purchase price (minus original outgoing freight costs) will be refunded to your original payment method.

6.2 Bespoke Commissions (Custom Artwork)

• Final Sale: Because custom commissions are uniquely tailored to your specific story, space, and aesthetic vision, we do not accept returns or exchanges on commission pieces for change of mind.

• Damaged in Transit: In the unlikely event that a bespoke commission arrives damaged, it is fully covered under section 6.3 below, and we will work with you immediately to repair, recreate, or resolve the issue.

6.3 Damaged or Faulty Items
We take immense pride in the quality and craftsmanship of every original piece, print, and sculpture. In the rare event that your piece arrives damaged during transit:

• Reporting: Please contact us with clear photographs of both the damaged artwork and the outer packaging within 24 hours of delivery.

• Resolution: Once verified, we will arrange for a repair, replacement, or refund.

7.1 Commissioned works require a non-refundable 50% deposit to begin. Once the final brushstroke is approved by the client and the balance is paid, no refunds or exchanges are permitted due to the custom nature of the work.

8.1 Your privacy is important to us. Please refer to our Privacy Policy for details on how we collect, use, and protect your personal information.

9.1 All content on this website, including images, text, photos, and designs, is protected by copyright law and is owned by Coastal Art Australia.

9.2 Unauthorized use, reproduction, or distribution of any content from this website is prohibited and may result in legal action.

9.3 Ownership of the physical artwork passes to the buyer upon payment, but copyright remains with the Artist. You may not reproduce, scan, or sell prints of the artwork without express written permission from the artist and Coastal Art Australia.

10.1 Coastal Art Australia will not be liable for any indirect, incidental, or consequential damages arising from the use of our website or products, including but not limited to loss of profits or data.

10.2 In no event shall Coastal Art Australia's liability exceed the amount paid for the products purchased.

11.1 By using our website, you agree to indemnify, defend, and hold harmless Coastal Art Australia, its affiliates, officers, and employees from any claims, damages, or liabilities arising from your use of the site or products.

12.1 These Terms and Conditions are governed by and construed in accordance with The Australian Consumer Law (ACL)

12.2 Any disputes arising from these terms will be subject to the exclusive jurisdiction of the courts in Australia.
